This Privacy Notice (this “Notice”) describes how LevelPlane, Inc. (“LevelPlane,” “we,” “us,” and/or “our”) collects, uses, discloses, and otherwise processes information in connection with the LevelPlane manufacturing procurement platform, including its drawing intelligence, RFQ automation, quote governance, and supply chain monitoring capabilities (collectively, the “LevelPlane Service”), made available through LevelPlane’s websites located at levelplane.ai and levelplane.com (the “Websites”) and via email-based access channels. This Notice forms part of and should be read together with our Terms of Service. Please contact LevelPlane at info@levelplane.ai if you have any questions about this Notice.
IMPORTANT — PLEASE READ THIS NOTICE CAREFULLY. By accessing or using the LevelPlane Service, you acknowledge that you have read and understood this Notice and consent to the collection, use, and disclosure of your information as described herein. If you do not agree to the practices described in this Notice, do not access or use the LevelPlane Service.
1. Scope and Controller
This Notice applies to all information collected by LevelPlane in connection with the LevelPlane Service, including information provided by users who register for an Account, submit procurement content, or otherwise interact with the Platform or Websites. LevelPlane, Inc. is the data controller responsible for your information. Where LevelPlane processes personal data on behalf of your organisation as a data processor, the terms of any applicable data processing agreement between LevelPlane and your organisation shall govern that processing.
2. Information We Collect
2.1. Account Information
When you register for an Account, we collect information such as your name, business email address, job role, and organisation details, including your organisation’s name and domain. This information is used to create and manage your Account and to associate your activity with your organisation as described in our Terms of Service.
2.2. Submissions
In the course of using the LevelPlane Service, you may submit, transmit, or upload technical drawings, CAD files, RFQ packages, pricing data, procurement specifications, messages, documents, and other content or materials (collectively, “Submissions”). We collect and process Submissions to operate the AI Features and to provide the LevelPlane Service to you. You retain ownership of your Submissions subject to the licences granted in the Terms of Service.
2.3. Usage Data
We automatically collect data and information derived from your use of the LevelPlane Service, including statistics, metrics, analytics, and performance data relating to the operation of the Platform and the processing of your Submissions (“Usage Data”). Usage Data may include information such as features used, queries submitted, actions taken, processing times, and error logs. LevelPlane retains all right, title, and interest in and to Usage Data as described in the Terms of Service.
2.4. Communications Data
If you contact LevelPlane for support or with enquiries, we collect the content of those communications, including your email address and any information you choose to provide. Where you have connected an email account to the LevelPlane Service, we access email metadata and content strictly as necessary to identify and process procurement-related communications on your behalf in accordance with the permissions you grant.
2.5. Technical and Device Data
We automatically collect technical information when you access the Websites or Platform, including your IP address, browser type and version, operating system, referrer URLs, device identifiers, and access timestamps. This information is collected for security monitoring, service operation, and fraud prevention.
3. How We Use Your Information
3.1. Provision of the Service
We use the information we collect to operate, maintain, and provide the LevelPlane Service, including to create and manage your Account, process and respond to RFQs and procurement communications on your behalf, generate AI-assisted outputs and recommendations, and fulfil our obligations under the Terms of Service.
3.2. AI Features
We use your Submissions and Usage Data to operate and improve the AI Features of the LevelPlane Service, including drawing intelligence, GD&T extraction, process routing, complexity scoring, and cost estimation capabilities. Where we use your Submissions to train or enhance AI models, we do so in accordance with the licence you grant us in the Terms of Service and applicable data protection law.
3.3. Communications
We use your contact information to send transactional notices, service updates, security alerts, and other communications relating to your use of the LevelPlane Service. We may also send information about new features, product updates, and procurement insights, from which you may opt out at any time by contacting us at info@levelplane.ai. As set out in the Terms of Service, you consent to receiving required communications electronically.
3.4. Service Improvement
We analyse Usage Data in aggregate and anonymised form to understand how the LevelPlane Service is used, to improve existing features, to develop new products and services, and to monitor the performance and reliability of the Platform. We will only publicly disclose Usage Data in aggregate, non-personally identifiable form.
3.5. Legal Compliance and Protection
We may use your information as necessary to comply with applicable laws and regulations, to respond to lawful requests from public authorities, to enforce our Terms of Service and other agreements, to detect and prevent fraud, abuse, and security incidents, and to protect the rights, property, or safety of LevelPlane, our users, or others.
4. Sharing and Disclosure
4.1. Service Providers
We share your information with third-party vendors and service providers that perform services on our behalf, including infrastructure and hosting providers, authentication providers, email delivery services, analytics providers, and customer support tools. These providers are permitted to use your information only as necessary to provide services to LevelPlane and are bound by contractual obligations consistent with this Notice.
4.2. Third-Party Integrations
The LevelPlane Service may connect to or integrate with third-party products, services, APIs, and ERP systems, including SAP, Oracle, Infor, Microsoft Dynamics, and others, as described in the Terms of Service. When you enable such integrations, information necessary to operate those integrations may be shared with the relevant third-party provider. Your use of any third-party integration is subject to that provider’s terms and privacy notices, and LevelPlane is not responsible for the privacy practices of third-party providers.
4.3. Legal Requirements
We may disclose your information if required to do so by law, regulation, or legal process, or if we reasonably believe that disclosure is necessary to comply with a lawful request from a government authority, to enforce our Terms of Service, to protect the safety or rights of any person, or to investigate fraud or security incidents.
4.4. Business Transfers
In connection with a merger, acquisition, reorganisation, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will provide notice to you of any such transfer and any material changes to how your information is handled.
4.5. Aggregated and Anonymised Data
We may share aggregated or anonymised information that does not identify any individual or organisation for industry research, benchmarking, marketing, or other business purposes. This information is not subject to the restrictions on sharing set out elsewhere in this Notice.
5. Data Retention
We retain your Account information and Submissions for as long as your Account remains active or as otherwise necessary to provide the LevelPlane Service and fulfil our legal obligations. If you close your Account by contacting us at info@levelplane.ai, we will delete or anonymise your personal information within ninety (90) days of Account closure, except where retention is required by applicable law or regulation, or where information is necessary to resolve disputes or enforce our agreements.
Usage Data derived from your use of the LevelPlane Service, including aggregated and anonymised analytics, may be retained indefinitely as part of LevelPlane’s proprietary Usage Data as described in the Terms of Service.
6. Security
LevelPlane implements industry-standard technical and organisational measures to protect your information against unauthorised access, disclosure, alteration, and destruction, including encryption of data in transit and at rest, access controls, and regular security assessments. LevelPlane uses WorkOS for identity and access management. However, no method of transmission over the internet or electronic storage is completely secure.
If you become aware of a potential security vulnerability or incident affecting the LevelPlane Service, please notify us promptly at info@levelplane.ai. In the event of a data breach that requires notification under applicable law, we will notify affected users and relevant authorities as required.
7. Your Rights and Choices
7.1. Access and Correction
You may request access to the personal information we hold about you and ask us to correct inaccurate or incomplete information. You can update certain Account information directly within the LevelPlane Service or by contacting us at info@levelplane.ai.
7.2. Deletion
You may request deletion of your personal information by closing your Account as described in Section 5. We will honour deletion requests subject to our legal obligations and the rights described in our Terms of Service, including LevelPlane’s right to retain Usage Data and Feedback.
7.3. Portability
Where required by applicable law, you may request a copy of your personal information in a structured, commonly used, and machine-readable format. Please contact us at info@levelplane.ai to submit a portability request.
7.4. Objection and Restriction
Where permitted by applicable law, you may object to or request restriction of our processing of your personal information. We will consider and respond to such requests in accordance with applicable data protection law.
7.5. Exercising Your Rights
To exercise any of the rights described in this Section 7, please contact us at info@levelplane.ai. We will respond to verified requests within thirty (30) days. We may need to verify your identity before processing your request. We will not discriminate against you for exercising your rights under this Notice or applicable law.
8. International Data Transfers
LevelPlane, Inc. is headquartered in San Francisco, California, United States. We operate globally, with offices in London, Guadalajara, Cochin, and Singapore. Your information may be transferred to, stored in, or processed in countries other than the country in which you are located, including the United States, where data protection laws may differ from those in your jurisdiction.
Where we transfer personal data from the European Economic Area, the United Kingdom, or other jurisdictions with data transfer restrictions, we implement appropriate safeguards such as standard contractual clauses or other lawful transfer mechanisms to ensure your information receives an adequate level of protection.
9. Cookies and Tracking Technologies
LevelPlane uses essential cookies and similar technologies to maintain your session, manage authentication state, and ensure the secure operation of the LevelPlane Service. We do not use advertising or cross-site tracking cookies. You can control cookie behaviour through your browser settings; however, disabling essential cookies will prevent you from accessing the LevelPlane Service.
10. Children's Privacy
The LevelPlane Service is not directed to individuals under 18 years of age, as stated in the eligibility requirements of our Terms of Service. LevelPlane does not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child, we will take steps to delete that information promptly. 11. Changes to This Notice
LevelPlane reserves the right to change, modify, or update this Notice at any time. If we revise this Notice, we will post the revised Notice on our Website, available at levelplane.com/privacy, and update the “Effective” date at the top. For material changes, we will provide reasonable prior notice by posting a prominent notice on our Website and/or by email to the address associated with your Account. Your continued use of the LevelPlane Service after the effective date of any revised Notice constitutes your acceptance of the revised Notice.
